Can foreigners actually buy property in Taiwan? Yes, but with conditions. Taiwan's Land Act Article 18 requires the "principle of reciprocity" — your home country must allow Taiwanese citizens to buy property there before you can buy property in Taiwan. Once reciprocity is confirmed, you also need to avoid the 7 restricted land types listed in Article 17 (forest land, water-source land, military zones, etc.), and be realistic about mortgage approval, which is generally harder for foreigners than for locals.

Our team at Fusheng Realty regularly works with foreign clients and cross-border families in Taichung. The 3 questions we hear most are: "Is my nationality even eligible?", "Can buying property get me a residence permit?", and "Will the bank actually approve my mortgage?" This guide answers all three in Traditional Chinese, English and Cantonese — switch languages using the buttons at the top.

Local government review time
14 working days
Legal deadline for approval/rejection
With ARC + Taiwan income
~50–70% loan
No ARC usually means cash purchase
Buying property alone
0% residency granted
Ownership and immigration are separate matters

(Updated July 2026, based on Taiwan MOI Land Administration Agency reciprocity rules and common bank lending practice)

Foreigner Property Eligibility Check

Take 30 seconds to check your situation — select your nationality category, whether you hold a residence permit, and whether you have Taiwan income, and you will get a rough read on where you stand before reading further.

Quick Eligibility Checker

This is a rough guide only — actual eligibility is confirmed case-by-case by a licensed land agent and the bank.

1. Can I Actually Buy? Reciprocity and Land Restrictions

Yes, but you need to clear 3 hurdles first. Land Act Article 18 says foreigners may acquire land rights in Taiwan only if their home country's law grants the same rights to Taiwanese citizens — this is the "principle of reciprocity". Taiwan's Ministry of the Interior maintains an official "Reciprocal Countries List". Japan, South Korea, most US states (except Oklahoma), the UK, Germany, France, Canada, Australia and New Zealand are all on the fully-reciprocal list. Hong Kong is on a separate "conditionally reciprocal" list — Hong Kong Permanent Resident ID holders (who carry no other country's travel document) can buy on the same terms as reciprocal-country foreigners. Indonesia, Cambodia, Vietnam, Myanmar, Brunei, Macau and Iran are on the non-reciprocal list, meaning nationals of those places generally cannot acquire land rights in Taiwan.

1
Nationality must meet reciprocity
Your home country's law must also let Taiwanese citizens buy property there
2
7 land types are off-limits
Forest, fishing, hunting, salt-flat, mining, water-source land, and military/border zones
3
Self-use, investment or public-welfare use only
Residential, business premises, offices, factories, churches, hospitals etc. are fine; major investment projects need prior approval from the relevant central authority

Even if your nationality qualifies and the property isn't restricted land, the process still requires filing through a licensed land agent (地政士) at the local Land Office, followed by approval from the municipal/county government (legally required within 14 working days), before the transfer can be completed. Always check the latest version of the MOI Reciprocal Countries List (official PDF, Chinese); the legal basis is the Land Act, Articles 17–19 (Chinese).

Our take: The reciprocity list changes as bilateral relations evolve — don't rely on something you read once. Confirm the current list before making an offer, especially if you hold dual nationality or a special status (e.g. naturalized, or married to a Taiwanese national), since individual cases can be assessed differently. Call our consultants directly to confirm your specific case rather than guessing.

2. Does Buying Property = Getting Residency? Busting the Biggest Myth

No — buying property and obtaining residency/immigration status are two completely separate matters. This is the most common misunderstanding among foreign clients: many assume "buy a house, get a status upgrade", but Taiwan's property registration system and immigration law are two entirely separate systems. Buying a house does not automatically grant you any residency right.

❌ MythSimply buying property automatically gets you Taiwan residency or immigration status.
✅ FactProperty ownership has no direct connection to residency status. Even holders of a Permanent Resident Certificate (APRC) are still legally classified as "foreigners" in property transactions until they complete naturalization and receive a Republic of China national ID card — property ownership is not a shortcut to status.

If you want to live in Taiwan long-term, these are the actual legal paths — not buying a house:

Work-based residency (employment/professional)Family-based residency (marriage/direct lineal relatives)Investment residency (setting up a company, not simply buying property; HK/Macau residents typically need to invest around NT$6 million)Professional talent / study-to-work pathway
Our take: Many of our clients get the order right by first deciding on their residency path, then buying property once they have stable status — this makes both the mortgage and tax situation much smoother. Doing it backwards (buy first, figure out residency later) often runs into real obstacles: banks refusing the mortgage, or being unable to claim the reduced land value tax rate.

3. Is It Hard to Get a Mortgage? Loan Ratios, Documents and Guarantors

Harder than for locals, but not impossible. Banks reviewing a foreigner's mortgage application care most about "ability to repay" and "stability of status" — what matters is not your passport nationality itself, but whether you hold a residence permit (ARC/APRC) valid for 6+ months and have stable local Taiwan income. The law does not ban foreigners from borrowing, but each bank sets its own lending policy. In practice, foreigner mortgages typically land around 50–70% loan-to-value (lower than the ~80% common for local first-time buyers), often with shorter terms (roughly 15–20 years) and slightly higher interest rates.

ARC + stable Taiwan income
~50–70% loan
ARC, no Taiwan income
Lower ratio, often needs a TW guarantor
No residence permit
Most banks decline; usually cash purchase

Documents commonly required: passport, ROC residence permit (valid 6+ months), 6+ months of payroll records or withholding statements, employment certificate, the sale-and-purchase contract, and land/building registration transcripts; some banks additionally require a creditworthy Taiwanese guarantor. Foreign buyers with no residence permit and no Taiwan income are typically declined outright by most banks — in practice these buyers often pay in full cash, or bring on a Taiwanese friend/relative as co-borrower guarantor.

Our take: Whichever situation you're in, we always recommend bringing on a Taiwanese guarantor or co-borrower (a spouse, family member, or creditworthy friend — banks usually prefer a relative within two degrees, but this can be confirmed case-by-case). Even if you already have an ARC plus stable Taiwan income and would qualify for 50–70% loan-to-value on your own, adding a Taiwanese guarantor can often help you secure a higher ratio and a better rate — banks are noticeably more confident lending when a Taiwanese national shares repayment responsibility, and approval is often faster too. Under Taiwan's Banking Act, banks cannot force borrowers to provide a "joint and several guarantor" for owner-occupied home loans, but borrowers can voluntarily offer an "ordinary guarantor" to improve their approval odds and terms — this is a common, legitimate strategy, not just a last resort for weak applicants.
Our take: Get a pre-approval assessment from a bank before you buy, so you know roughly what loan-to-value and rate you can expect before making an offer — and build a "financing contingency clause" into the contract, so if the approved amount falls short, you can withdraw your deposit or renegotiate the price rather than discovering the shortfall after signing.

4. Hong Kong, Macau, Mainland China and Vietnam: Very Different Rules

Many people assume "Asian nationalities are all treated similarly" — but Hong Kong, Macau, Mainland China and Vietnam are each governed by independent, quite different rules, and lumping them together is a common and costly mistake.

StatusGoverning ruleCan buy?Main restriction
Hong Kong residentTreated as foreigner under Land Act (conditionally reciprocal)YesMust hold a Hong Kong Permanent Resident ID and may not hold any other country's travel document besides a British National (Overseas) or Hong Kong passport — handled the same as other reciprocal-country foreigners once that's confirmed
Macau residentLand Act Article 18 (does not meet reciprocity)NoBecause Macau does not allow private individuals to freely acquire full property ownership, it fails the reciprocity test; the MOI has ruled Macau residents cannot acquire land rights in Taiwan
Mainland China residentAct Governing Relations Between Peoples of the Taiwan Area and the Mainland Area, Art. 69 + permit regulationsYes (permit required)Limited to 1 self-use residential unit per person, cannot be rented out, no resale within 3 years of registration, requires prior MOI approval, ≤10% concentration per community, and annual national quotas (13 hectares of land / 400 housing units)
Vietnamese national (non-naturalized)Land Act Article 18 (listed as non-reciprocal)Generally noVietnam is currently on the non-reciprocal list; those already naturalized as ROC citizens or with another qualifying status are not subject to this restriction — confirm your specific case
Our take: The mix-up we see most is "Hong Kong ≠ Mainland China" — Hong Kong residents are actually treated like ordinary foreigners under the reciprocity principle, which is far more relaxed than the Mainland's "1-unit, 3-year lock, 10%-community-cap" regime. Likewise, Vietnamese-heritage clients who have already naturalized as Taiwanese citizens or hold spousal status are assessed completely differently from someone holding only a Vietnamese passport — never assume one rule fits all.

5. The 6-Step Buying Process + Document Checklist

The foreigner buying process adds two extra checkpoints compared with a local purchase — "reciprocity review" and "government approval" — everything else is largely the same:

  1. Step 1|Confirm eligibility and reciprocity statusCheck the current reciprocal-country list and confirm the property isn't a restricted land type under Article 17
  2. Step 2|View properties, negotiate, sign the sale-and-purchase contractInclude a financing contingency clause, and make sure the contract includes the reciprocity declaration wording
  3. Step 3|Prepare application documentsPassport (or residence permit), identity documents, sale-and-purchase transfer contract, tax payment/exemption certificate, reciprocity proof (waived if your country is already on the list), power of attorney (if you cannot attend in person)
  4. Step 4|Submit to the Land OfficeA licensed land agent files the case; the Land Office conducts an initial document review
  5. Step 5|Municipal/county government approvalAfter the initial review passes, the case goes to the municipal or county government, legally required to approve/reject within 14 working days; major investment cases additionally need prior approval from the relevant central authority
  6. Step 6|Pay taxes, complete the transfer, receive the title deedPay deed tax, stamp duty and other fees, complete the ownership transfer registration, and receive the title certificate
Our take: The whole process, including approval, typically takes about 1–2 months longer than a purchase between two Taiwanese nationals — factor this extra waiting period into your negotiation and settlement timeline so you don't agree to a handover date that's too tight.

6. Taxes: Do Foreigners Pay the Same as Locals?

The tax categories are basically the same — deed tax, house tax, land value tax, the consolidated housing and land income tax, and land value increment tax all apply to foreign buyers and sellers under the same rate structure. The biggest difference is the "self-use residential preferential rate": the standard land value tax rate is 10‰–55‰; if you hold household registration and genuinely occupy the property as your own home, you can apply for the preferential 2‰ rate — but most foreigners have no Taiwan household registration, so unless you hold a residence permit and the tax authority approves your actual self-use occupancy, you cannot claim this discount and will generally be taxed at the standard rate. The consolidated housing and land income tax is based purely on holding period (45% within 2 years, 35% for 2–5 years, 20% for 5–10 years, and a lower bracket beyond 10 years) — this part applies identically regardless of nationality.

Our take: A lot of foreign clients underestimate the gap between the standard and preferential land value tax rates — without the self-use discount, your long-term holding cost is noticeably higher. Ask about your eligibility for the preferential rate before you buy, not after the tax bill arrives and turns out much bigger than expected.

7. Where Taiwan Differs From Many Other Countries: Mortgage Timing and Home Inspection

Many foreign clients assume the buying process works the same way as back home, and get caught off guard by two big differences in Taiwan: when the mortgage gets approved, and how home inspection actually works. Understanding these two points before you sign anything will save you a lot of surprises.

Difference 1: Mortgage timing — Taiwan signs first, then applies for the loan; most countries get loan approval before signing

In the US and many other countries, buyers typically must obtain a lender's Pre-Approval Letter — proof they can actually borrow the money — before making an offer at all. Once the contract is accepted, the deal moves into an escrow (third-party holding) period, during which the bank runs its final, full underwriting review; funds are only released once every condition is satisfied. In other words, by the time you sign, you already have a very high degree of certainty about your financing.

Taiwan — especially for pre-sale (預售屋) housing — works the opposite way: buyers typically sign the contract first, then pay the down payment and construction installments as the project progresses. The formal mortgage application and bank sign-off usually don't happen until 1–2 months before handover, once the building has received its occupancy permit. That means you won't know your actual loan outcome until long after you've signed — if the approved amount falls short, at best you'll need to cover the gap in cash, and at worst you could end up in breach of contract.

Our take: This is exactly why we recommend every client — foreign or local — get a bank pre-assessment before signing, and insist on a financing contingency clause in the contract. If the approved loan amount comes in lower than expected, this clause lets you withdraw your deposit or renegotiate the price. In Taiwan, this is a critical form of self-protection, not an optional extra.

Difference 2: Home inspection — Taiwan focuses on structure/water/electrical; many countries build inspection into the contract by default

In the US, a home inspection is a standard contingency built into the purchase contract. Within 5–7 days of the contract being signed, the buyer pays a licensed Home Inspector to perform a comprehensive, non-invasive check covering structural surfaces, the roof, plumbing, electrical systems, HVAC, smoke detectors and more. If the inspector flags a serious structural concern — say, a foundation crack wider than roughly 1/8 inch with visible displacement — the buyer is referred to a licensed Structural Engineer, who can produce a legally-binding assessment. The whole process is essentially built into the standard home-buying workflow; buyers rarely need to remember to arrange it themselves.

Taiwan's resale-home inspection process has no equivalent contractual default — it depends entirely on the buyer proactively arranging it. In practice, the focus is mainly on three areas: structural columns/beams, plumbing, and electrical wiring. The mainstream approach is to hire a multi-disciplinary inspection team (covering structural, plumbing/electrical, and finishing trades, each with separate government-issued qualifications); only when there's genuine suspicion of a serious structural issue (e.g. a 45-degree diagonal crack running through a wall, or visible tilting) would you separately commission a licensed civil/structural engineer for a dedicated assessment. The key point: in Taiwan, it's on the buyer to actively request and arrange the inspection — it's not an automatic step baked into the contract.

Our take: If you're used to a home market where inspection contingencies are standard and automatic, remember that in Taiwan you need to raise this yourself and actively arrange your own inspection team when buying a resale home — don't assume the process will protect you the way it does back home. This is one of the most easily overlooked, but highest-impact, procedural differences.

Who Should Buy Now, Who Should Wait

Good to proceed now: foreigners who already hold a valid residence permit (ARC/APRC) with stable Taiwan income, whose nationality is on the fully-reciprocal list, and who have already decided to live in Taiwan long-term or have a Taiwanese spouse — this group generally gets more favorable mortgage terms and tax treatment.

Better to wait: buyers whose nationality is on the non-reciprocal list, who have neither residence status nor Taiwan income, or who are hoping to buy property purely as a shortcut to residency — for these situations, the groundwork (financing, status determination) takes longer. Call our consultants first to confirm feasibility for your specific case before you commit.

Frequently Asked Questions

Can someone of my nationality actually buy property in Taiwan? +

Check the MOI's "Reciprocal Countries List" first. Japan, South Korea, most US states, the UK, Germany, France, Canada, Australia and New Zealand are on the fully-reciprocal list and can buy. Hong Kong is conditionally reciprocal — Permanent Resident ID holders can buy on the same terms. Indonesia, Cambodia, Vietnam, Myanmar, Brunei and Macau are on the non-reciprocal list and generally cannot — unless the individual has naturalized or holds another qualifying status, which needs case-by-case confirmation.

Can buying property get me a residence permit or immigration status? +

No. Simply buying property does not automatically grant residency or immigration status — property registration and immigration status are two entirely separate systems. To stay long-term you need a legal path such as work-based residency, family-based residency, investment residency (setting up a company, not just buying property) or the professional talent pathway.

Is it hard for foreigners to get a mortgage in Taiwan? +

Harder than for locals, but foreigners holding a residence permit valid 6+ months plus stable Taiwan income can still typically get 50–70% loan-to-value. Buyers with no residence permit and no Taiwan income are usually declined by most banks, and in practice often need to pay full cash or bring on a Taiwanese guarantor. We always recommend foreign clients bring on a Taiwanese guarantor or co-borrower when applying — even if you already meet the ARC-plus-income bar, adding one can often secure a higher loan-to-value ratio, a better rate, and faster approval.

Are Mainland Chinese residents subject to the same rules as other foreigners? +

No, and the restrictions are considerably stricter. Mainland Chinese residents fall under the Act Governing Relations Between Peoples of the Taiwan Area and the Mainland Area: limited to 1 self-use residential unit per person, cannot rent it out, cannot resell within 3 years of registration, requires prior MOI approval, plus an annual national quota and a 10% concentration cap per community — a completely separate regime from the general reciprocity principle that applies to other foreigners.

Are Hong Kong buyers treated the same as Mainland Chinese buyers? +

No. Hong Kong residents are treated as ordinary foreigners under the Land Act's reciprocity principle, which is very different from the Mainland's "1-unit, 3-year resale lock" restriction. As long as you hold a Hong Kong Permanent Resident ID, you're handled the same as reciprocal-country foreigners — far more relaxed. Macau residents, on the other hand, currently cannot acquire Taiwan land rights at all, because Macau fails the reciprocity test.

Do foreigners pay the same property taxes as locals? +

The tax categories are the same (deed tax, house tax, land value tax, consolidated housing-and-land income tax, etc.), but the 2‰ "self-use residential preferential rate" for land value tax requires household registration plus approved actual self-occupancy. Most foreigners lack Taiwan household registration, so they cannot claim this discount and are generally taxed at the standard 10‰–55‰ rate, meaning a higher holding cost than a local owner-occupier.

Why does Taiwan sign the contract before arranging the mortgage — isn't it the other way around where I'm from? +

Because in most countries (like the US), buyers get a lender's pre-approval letter before making an offer, so the loan outcome is largely settled by the time you sign. In Taiwan, especially for pre-sale housing, you sign first and pay installments as construction progresses; the formal mortgage application only happens 1–2 months before handover. Get a bank pre-assessment before signing, and insist on a financing contingency clause in your contract.

Is home inspection in Taiwan the same as back home? +

No. In markets like the US, a home inspection is a standard contract contingency — a licensed inspector checks the property automatically after signing, with a structural engineer referral if serious issues appear. Taiwan has no such built-in clause; inspections mainly cover structural columns/beams, plumbing and electrical, and the buyer must proactively hire a multi-disciplinary inspection team, escalating to a licensed civil/structural engineer only if a real structural concern is suspected.

Bottom Line: Confirm Your Status Before You Make an Offer

Buying property as a foreigner in Taiwan is entirely possible — but the order matters: confirm your nationality's reciprocity status, your residency plan, and your mortgage feasibility before you decide to make an offer. Hong Kong, Mainland China and Vietnamese nationals each face very different rules — never apply the same logic across all of them. Use the language switcher and eligibility checker above right now, and for anything case-specific, call our foreign-language consultants directly — it will save you a lot of guesswork.
